INDUSTRIAL INJURY SECTION

1. Industrial Injury Benefits are payable under Sub-part III of the Social Contribution and Social Benefits Act 2021 and are deemed to have come into operation on 1 September 2020, except in relation to a self-employed which is effective as from      the commencement of this Act, that is, 1 September 2021.
  1. 2. For injury sustained following an industrial accident or caused by a prescribed disease prior to 01 September 2020, the Industrial Injury Benefits are payable under the repealed Part V of the National Pensions Act 1976.

  2. A.    Industrial Injury Benefit (IIB)

  3. ELIGIBILITY

  4. (i) Payable to an employee or self-employed who suffers a personal injury caused by an industrial accident or suffers a prescribed disease (being a disease due to the nature of his employment) resulting in temporary total incapacity for work.
  1. (ii) Payable in the case of:

  2.         (a) an employee - as from the 15th day of temporary total incapacity for work (Full compensation to be paid by the employer for first two weeks of temporary total incapacity at the same rate that the employee was being remunerated at the time the                           industry injury occurred).
  3.          (b) a self-employed - as from the first day of incapacity provided the period of incapacity exceeds 2 weeks as certified by a government Medical Officer.

  4. AMOUNT PAYABLE

  5. The IIB payable shall be equal to 100% of the monthly earnings of the employee or net income derived by a self-employed, not exceeding the amount specified in Part II of the First schedule to the SCSB Act 2021.


  6. DOCUMENTS TO BE PRODUCED (in original format + photocopies)

  7. (i)  Birth Certificate;
  8. (ii) National Identity Card;
  9. (iii) Medical Certificates/Evidence; and
  10. (iv) Bank Account Number and Name of Bank.
  11.        ​In the case of a joint account, the National Identity Card(s) of Joint account holder(s) should be produced.

  12. B.     Disablement Benefit (DB)

  13. ELIGIBILITY

  14. Payable to an employee or self-employed who has suffered an industrial injury resulting in a disablement.

  15. AMOUNT PAYABLE
  1. a) Where the disablement is 100%, the Disablement Benefit would be equal to 80% of the monthly earnings of the employee or self-employed.
  2. b) Where the disablement is less than 100%, the DB would be equal to 65% of the monthly earnings of the employee or self-employed, multiplied by the percentage (%) of his disablement.
  3. c) The employee or self-employed may elect to receive a lump sum payment in lieu of a monthly Disablement Benefit- (Conditions apply)

  4. DOCUMENTS TO BE PRODUCED (in original format + photocopies)

  5. (i)   Birth Certificate; 
  6. (ii)  National Identity Card;
  7. (iii) Medical Certificates/Evidence; and
  8. (iv) Bank Account Number and Name of Bank.
           In the case of a joint account, the National Identity Card(s) of Joint account holder(s) should be produced.

     C.     Other Benefits (in addition to Industrial Injury Benefit or Disablement Benefit) are payable for :-
    1. a. Constant Personal Attendance
    2. b. Artificial Aid
    3. c. Damage to natural teeth, clothing, spectacles or any artificial aid being worn or used at the time of the industrial accident
    4. d. Medical, Surgical attendances and other expenses rendered necessary as a result of the industrial accident

      NOTE: CONDITIONS APPLY


    5. DOCUMENTS TO BE PRODUCED (in original format + photocopies)

    6. (i)   Birth Certificate;
  1. (ii)  National Identity Card;
  2. (iii) Medical Certificates/Evidence; and
  3. (iv) Bank Account Number and Name of Bank.
           In the case of a joint account, the National Identity Card(s) of Joint account holder(s) should be produced.

    D.    Survivor's Benefit (SB)

  4. ELIGIBILITY

  5. (i) Payable to the surviving spouse of an employee or self –employed who has
  6.      - died as a result of an industrial accident; or
  7.      - disappeared during the course of his employment/profession, trade or business.
  8. (ii) In case of disappearance or missing person, a survivor's benefit is payable after the expiry of 3 months from the date the matter was reported to the police (Conditions apply).
  9. (iii) The benefit ceases:
  •         - in case of remarriage of the surviving spouse; or
  •         - if Retirement Benefit payable is higher than Survivor's Benefit.
    (iv)The surviving spouse is entitled to receive either the Retirement Benefit or the Survivor's Benefit, whichever is the higher.


  • AMOUNT PAYABLE

  • The Survivor's Benefit is 50% of the monthly earnings (amount specified in Part 2 and of the 1st Schedule to the SCSB Act2021) of the deceased or self-employed.


  • DOCUMENTS TO BE PRODUCED (in original format + photocopies)

  • (i)   Birth Certificates and National Identity Cards (for both applicant and deceased spouse);
  • (ii)  Marriage Certificate (not less than 3 months); 
  • (iii) Death Certificate of Spouse; and
  • (iv) Bank Account Number and Name of Bank.
  •       In the case of a joint account, the National Identity Card(s) of Joint account holder(s) should be produced.


  • E. Child Allowance(CA)

 

ELIGIBILITY
(a)  Payable in respect of the child (ren), to beneficiaries drawing a Widow's Basic pension, an Invalid's Basic Pension or/and a Survivor's Pension provided that the child:

  1.       (i)   Is of legitimate, natural, stepchild or adopted issue;
  2.       (ii)  Is living with or wholly or substantially maintained by the person concerned;
  3.       (iii) Is born not later than 300 days after the death of the husband (in the case of a Widow's Basic or/and Survivor's pension);
  4.       (iv) Is under the age of 15 or 20 if in full-time education or between 20 and 23 years old if pursuing a full –time course at a Higher Education Institution; and
  5.       (v)  Must not be in receipt of an Orphan's or Invalid's Basic Pension.

  6. (b)  CA is payable in respect of not more than 3 children.


  7. DOCUMENTS TO BE PRODUCED (in original format + photocopies)

  8. (i) Birth Certificate of each child;
  9. (ii) The National Identity Card  of children aged 18 or above;
  10. (iii) Certificate of Attendance from Educational Institutions (for children aged 15 years or more);
  11. (iv) Bank Name and Bank Account Number – In case of a joint account, the National Identity Card(s) of Joint account holder(s) should be produced; and
  12. (v)  Passports (where applicable). 

    F.     Dependent's Benefit

  13. ELIGIBILITY

  14. Payable -
  1. (i)  where an employee or self-employed dies as a result of an industrial injury or has disappeared during the course of his employment/profession, trade or business and leaves no surviving spouse.
  2. (ii)  to a close relative (other than an orphan) who:
  1.       (a) was living in the same household; and
  2.       (b) was wholly or partly dependent on the earnings of the deceased employee or self-employed.

  3. NOTE: The meaning of a relative is given at Section 29, Subsection 29(4b), of the SCSB Act 2021

  4. AMOUNT PAYABLE

  5. The Dependent's Benefit is payable at the prescribed rate.         

  6. DOCUMENTS TO BE PRODUCED (in original format + photocopies)

  7. (i) Birth Certificate;
  8. (ii) National Identity Card of applicant and deceased employee/self-employed; 
  9. (iii) Death Certificate of the deceased employee /self-employed; and 
  10. (iv)  Bank Account number and Name of Bank.

  11. In the case of a joint account, the National Identity Card(s) of Joint account holder(s) should be produced.

  12. G.    Orphan's Benefit (OB)

  13. ELIGIBILITY

  14. 1. Payable where -
  1. (i) an employee or self-employed dies as a result of an industrial injury or has disappeared during the course of his employment and leaves one or more orphans;
  2. (ii) the orphan is under the age of 16 or is under the age of 23 and receiving full-time education; and
  3. (iii) is not married.

  4. 2. The Orphan's Benefit is payable to:-
  1. (i)   the guardian of the orphan; or
  2. (ii)  such other person as the National Pensions Officer may determine; and
  3. (iii) devoted by the person receiving it for the exclusive benefit of the orphan.

     
  4. AMOUNT PAYABLE

  5. The OB is equal to 15% of the half-monthly earnings of the employee or self-employed but shall in no case, be less than the Orphan's Pension under section 5 of the National Pensions Act.

  6. Formula: [15% *(50% * monthly earnings of the deceased employee or self-employed)].


  7. DOCUMENTS TO BE PRODUCED (in original format + photocopies)

  8. (i) Birth Certificates of each orphan, deceased parents, guardian;
  9. (ii) Marriage Certificate of parents, guardian (if applicable);
  10. (iii) National Identity Cards of deceased parents, guardian, orphan (if aged 18 years and above);
  11. (iv) Death Certificates of parents; and
  12. (v)  Bank Account Number of guardian and Name of Bank. 
  13.      In the case of a joint account, the National Identity Card(s) of Joint account holder(s) should be produced.
