font-family: var( --e-global-typography-text-font-family ), Sans-serif;\">\u00a0 \u00a0 \u00a0 THE EMPLOYMENT RIGHTS ACT 2008<\/strong><\/p><p>\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 Act No. 33 of 2008, into effect as from feb.2009<\/p><p><strong><u>OBJECTIVE: <\/u><\/strong><\/p><p>Ensuring appropriate protection to workers at time of distress especially when a worker\u2019s employment has been terminated.<\/p><p><strong><u>WORKER- TO JOIN THE PROGRAMME<\/u><\/strong><\/p><p>\u00a0 \u00a0 &#8211; A worker contributing to NPS loses his job<\/p><p>\u00a0 \u00a0 &#8211; And also a worker whose employment has been terminated shall be entitled to join the Workfare Programme.<\/p><p><strong><u>&#8220;worker\u201d does not include<\/u><\/strong> \u2013<\/p><p>(a) a public officer;<\/p><p>(b) a person employed by a parastatal body or by a local authority;<\/p><p>(c) a part-time worker;<\/p><p>(d) a migrant worker;<\/p><p><span style=\"background-color: transparent; font-family: var( --e-global-typography-text-font-family ), Sans-serif; font-weight: var( --e-global-typography-text-font-weight );\">(e) a worker employed in the sugar industry who voluntarily retires \u2013<\/span><\/p><p>\u00a0 \u00a0 \u00a0(i) in the context of a Voluntary Retirement Scheme under section 23 of the Sugar Industry Efficiency Act 2001;<\/p><p>\u00a0 \u00a0 \u00a0(ii) an Early Retirement Scheme under section 23A of the Sugar Industry Efficiency Act 2001; or<\/p><p>\u00a0 \u00a0 \u00a0(iii) a factory closure pursuant to section 24 of the Cane Planters and Millers Arbitration and Control Board Act;<\/p><p>(f) a person reckoning less than 6 months continuous employment with an employer as at the date of the termination of his employment<\/p><p><strong><u>Workfare programme shall consist of:<\/u><\/strong><\/p><p>\u00a0 \u00a0&#8211; Payment of a transition unemployment benefit to every worker whose (employment ) agreement has been terminated and who opts to join the\u00a0 workfare programme<\/p><p><strong><u>What the worker has to do?<\/u><\/strong><\/p><ul><li>He shall register himself with the Permanent Secretary (Ministry of Labour and Human Resource Development) within 30 days of the termination of his employment<\/li><li>The Permanent Secretary may extend the time if good cause is shown.<\/li><\/ul><p>\u00a0<\/p><p><strong><u>TRANSITION UNEMPLOYMENT BENEFIT<\/u><\/strong><\/p><ul><li>Every worker registered in the Workfare Programme shall be entitled to a transition unemployment benefit for a minimum period of one month and a maximum period of 12 months as follows:<\/li><\/ul><table width=\"671\"><tbody><tr><td width=\"255\"><p>Period after termination of employment<\/p><\/td><td width=\"416\"><p>Rate of benefit per month<\/p><\/td><\/tr><tr><td width=\"255\"><p>First 3 months<\/p><\/td><td width=\"416\"><p>90% of insurable wage or salary but not less than RS 3000<\/p><\/td><\/tr><tr><td width=\"255\"><p>From 4<sup>th<\/sup>\u00a0month to end of 6<sup>th<\/sup>\u00a0month<\/p><\/td><td width=\"416\"><p>60% of insurable wage or salary but not less than RS 3000<\/p><\/td><\/tr><tr><td width=\"255\"><p>From 7<sup>th<\/sup>\u00a0month to end of 12<sup>th<\/sup>\u00a0month<\/p><\/td><td width=\"416\"><p>30% of insurable wage or salary but not less than RS 3000<\/p><\/td><\/tr><\/tbody><\/table><p><strong><u>Transition Unemployment Benefit (TUB):-<\/u><\/strong><\/p><p>will cease as from the end of month in which the worker:<\/p><p>(<span style=\"background-color: transparent; font-family: var( --e-global-typography-text-font-family ), Sans-serif; font-weight: var( --e-global-typography-text-font-weight );\">a) opts out of the Workfare Programme;<\/span><\/p><p><span style=\"background-color: transparent; font-family: var( --e-global-typography-text-font-family ), Sans-serif; font-weight: var( --e-global-typography-text-font-weight );\">(<\/span><span style=\"background-color: transparent; font-family: var( --e-global-typography-text-font-family ), Sans-serif; font-weight: var( --e-global-typography-text-font-weight );\">b) becomes gainfully employed;<\/span><\/p><p>(c) refuses an offer for job placement for a second\u00a0 time;<\/p><p>(d) is admitted by the Human Resource Development Council to a training or re-skilling scheme;<\/p><p>(e) sets up a small business with the assistance of the Small Enterprises and Handicraft Development Authority;
